QuikCliqs Terms of Use

1. Who can use QuikCliqs

You must be at least 18 years old and able to enter into a binding contract. QuikCliqs is offered in the United States.

2. What QuikCliqs is, and what it isn't

QuikCliqs helps you describe a home problem or project, get a free AI cost estimate, find service providers (including ones people you know recommend), send them your request, and compare their quotes.

• We are a connection platform. We don't perform home services, and we don't employ, supervise or control service providers. Providers are independent businesses.
• We don't guarantee any provider's work, pricing, timing, licensing, insurance, conduct or results. Any agreement for work is between you and the provider.
• Where provider information comes from. It may come from the provider, from people on QuikCliqs who recommend them, from public business directories, or from Google. Information we haven't checked may be incomplete or out of date.
• "ID verified" means the provider passed our identity check (we confirmed who they are). It does not mean we checked their skills, licenses, insurance or work quality. Ask providers for proof of licensing and insurance before hiring, and check any licensing your town or state requires.

3. AI estimates and coverage checks

Our cost estimates and insurance, warranty or credit card "coverage checks" are produced with the help of AI. They are information only, may be wrong, and are not quotes, not insurance advice, and not legal advice. Actual prices are set by providers. Only your insurer, warranty company or card issuer can decide whether something is covered. Always confirm with them.

4. Your account

Give us accurate information and keep it current. Keep your sign-in details secure; you're responsible for activity on your account. Tell us at support@quikcliqs.com if you think someone else used it.

5. Sending requests and contacting providers

When you send a request, you ask us to share your request (the description, photos and ZIP area) with the providers you choose, including businesses that aren't on QuikCliqs, by email or in the app. We share your name, phone number and address with a provider only after you invite them for a visit or hire them, and only once they've passed our ID verification. If you text or call a provider from your own phone, that message is yours, sent by you.

6. Cliqs, recommendations, reviews and your content

You keep ownership of the content you post (photos, descriptions, reviews, vouches, notes, Cliq posts). You give QuikCliqs a non-exclusive, royalty-free, worldwide license to host, store, display and share that content to operate and improve the Service, for example showing your request to the providers you choose or your vouch to members of your Cliq. This license ends when you delete the content or your account, except for copies others already received or that we must keep by law.

• Be honest. Reviews and recommendations must reflect your genuine experience. Don't post fake reviews, review a business you own or work for, or offer or accept anything in exchange for a positive review.
• Our Community Guidelines are part of these Terms. We have zero tolerance for abusive users or objectionable content. You can report content or members and block members in the app. We aim to act on reports within 24 hours, starting with safety and harassment reports, and may remove content or accounts that break the rules.

7. Things you may not do

Don't: break the law; harass, threaten or discriminate against anyone; post false, misleading or someone else's private information; send fake requests or spam; impersonate anyone; copy, scrape or resell data from the Service; interfere with or try to get around the Service's security; or use the Service to build a competing directory.

8. Texts, emails and notifications

If you give us your phone number, you agree to receive texts from QuikCliqs about your account and jobs, such as verification codes. Message frequency varies. Msg & data rates may apply. Reply STOP to opt out, HELP for help. We also send emails and, if you allow them, push notifications about your requests, quotes and account. We don't sell your phone number or use it for third-party marketing.

9. Google Maps content

Some provider information and ratings come from Google Maps. By using the Service, you also agree to the Google Maps/Google Earth Additional Terms of Service, and Google's handling of data is governed by the Google Privacy Policy.

10. Payments

QuikCliqs is free for homeowners. We don't process payments between you and providers. You pay providers directly, and any dispute about price, work or payment is between you and the provider.

12. Disclaimers

The Service is provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We don't promise the Service will be uninterrupted, error-free, or that any provider will respond, quote or perform.

13. Limitation of liability

To the fullest extent the law allows, QuikCliqs and its owners, employees and agents are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, data or goodwill, or for any damage, injury or loss arising from work performed (or not performed) by a provider, or from decisions you make based on AI estimates or coverage checks. Our total liability for any claim relating to the Service is limited to one hundred U.S. dollars ($100). Some states don't allow these limits, so some may not apply to you.

14. Indemnity

You agree to defend and hold QuikCliqs harmless from claims, losses and costs (including reasonable attorneys' fees) arising from your misuse of the Service, your content, or your violation of these Terms or the law.

15. Ending your account

You can delete your account at any time (see How account deletion works). We may suspend or end your access if you break these Terms or to protect users or the Service. QuikCliqs reserves the right, at our discretion and with or without notice, to remove content, limit or block features or activity, suspend or delete an account, and deny access to the Service, including where we find that an account is abusing the Service, other members or providers, or our systems. Sections that by their nature should survive (for example 6, 12–14, 16) survive.

16. Governing law and disputes

These Terms are governed by the laws of the State of New Jersey, without regard to its conflict-of-law rules. Any dispute will be resolved exclusively in the state courts located in Middlesex County, New Jersey, or the United States District Court for the District of New Jersey, and you and QuikCliqs consent to those courts' jurisdiction. Before filing a claim, please email support@quikcliqs.com so we can try to resolve it informally.

17. Changes to these Terms

We may update these Terms. When we make a material change, we'll update the date above and tell you in the app before it takes effect. Continuing to use the Service after that means you accept the updated Terms.

18. If you downloaded the app from Apple's App Store

These Terms are between you and QuikCliqs, not Apple. Apple isn't responsible for the app or its content, has no obligation to provide maintenance or support, and isn't responsible for any claims relating to the app (including product liability, legal compliance or intellectual-property claims). If the app fails to conform to any applicable warranty, you may notify Apple for a refund of the purchase price (if any). To the maximum extent the law allows, Apple has no other warranty obligation. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You confirm you're not located in a country subject to a U.S. Government embargo, and you're not on any U.S. Government list of prohibited or restricted parties.
